NFL asks US judge to toss concussion lawsuits

PHILADELPHIA (AP) ? The NFL moved Thursday to try to shut down lawsuits filed by thousands of former players who say they suffered or fear suffering permanent brain injuries from football-related concussions, calling the issue a "labor dispute" that should be resolved not by courts but by terms of the collective bargaining agreement.

The players accuse the NFL of negligence and say league officials concealed known medical links between concussions and brain injuries, leading many of them to suffer from dementia or Alzheimer's disease, or be at an increased risk of reckless or suicidal behavior.

In a motion to dismiss the suits filed late Thursday, the NFL argues that the collective bargaining agreement covers safety and health rules ? while delegating to each team decisions about a player's condition and when they should return to play. And the league said the suits lack any specific proof of concealment.

"To the extent that plaintiffs have a claim addressing injuries incurred during their NFL careers, that claim may only proceed pursuant to the grievance procedures set forth in the CBAs," the motion said.

About 140 NFL concussion lawsuits have been consolidated in federal court in Philadelphia before U.S. District Judge Anita B. Brody. Unless Brody agrees to dismiss them early on, or an umbrella settlement is reached, she will likely decide what evidence can be used at trial, whether a class can be certified for medical monitoring and other pretrial issues. The cases might then return to their home district for trial.

According to an Associated Press analysis, 3,377 players have sued the NFL, charging that not enough was done to inform them of the dangers of concussions in the past, or to take care of them today. That tally includes at least 26 Hall of Famers. There are 5,249 total plaintiffs, including spouses, other relatives and player representatives.

The lead plaintiff in an early concussion lawsuit filed last year, former Atlanta Falcons safety Ray Easterling, committed suicide in April at age 62. An autopsy found he had the degenerative brain disease CTE, or chronic traumatic encephalopathy. His widow remains a plaintiff.

Other players have told The Associated Press that they were put back into games after devastating hits, and were fed painkillers by team doctors before games to mask their pain.

Tony Dorsett, the Heisman Trophy winner and former Dallas Cowboys star who played in the NFL from 1977-88, attributes his memory problems to the hits and concussions he suffered in his 12-year career, including one that knocked him out cold in a 1984 game against Philadelphia. He nevertheless returned to the field, he said.

"Did they know it was a concussion?" Dorsett, a plaintiff, asked rhetorically in an AP interview. "They thought I was half-dead."

Doctors now say the regions of his brain that control organization and memory are not getting enough oxygen, Dorsett said.

The league said that at least two federal courts have agreed that the collective bargaining agreement dictates a player's right to compensation for injuries, once in a suit involving the late Dave Duerson, who killed himself last year.

The Minnesota Supreme Court likewise refused to let the widow of Vikings lineman Korey Stringer pursue a wrongful death suit after he died of heatstroke following a 2001 practice, on grounds the claim was trumped by the collective bargaining agreement. Stringer's wife later settled with the NFL over a negligence claim.

The league, meanwhile, insists that player safety has long been a priority.

"Any allegation that the NFL intentionally sought to mislead players has no merit. It stands in contrast to the league's actions to better protect players and advance the science and medical understanding of the management and treatment of concussions," the league said in a statement earlier this year.

Washington, DC, August 30, 2012 Less than half of U.S. schools address pandemic preparedness in their school plan, and only 40 percent have updated their school plan since the 2009 H1N1 pandemic, according to a study published in the September issue of the American Journal of Infection Control, the official publication of the Association for Professionals in Infection Control and Epidemiology (APIC).

A team of researchers from Saint Louis University collected and analyzed survey responses from approximately 2,000 school nurses serving primarily elementary, middle, and high schools in 26 states to ascertain whether schools were prepared for another pandemic, particularly focusing on infectious disease disasters. Pandemic preparedness is critical not only because of ramifications of the 2009 H1N1 pandemic, but also because of the threat of a future pandemic or an outbreak of an emerging infectious disease, such as severe acute respiratory syndrome. School preparedness for all types of disasters, including biological events, is mandated by the U.S. Department of Education.

The team found that less than one-third of schools (29.7 percent) stockpile any personal protective equipment, and nearly a quarter (22.9 percent) have no staff members trained on the school's disaster plan. One-third (33.8 percent) of schools report training students on infection prevention less than once per year. Only 1.5 percent of schools report stockpiling medication in anticipation of another pandemic. On a positive note, although only 2.2 percent of schools require school nurses to receive the annual influenza vaccine, the majority (73.7 percent) reported having been vaccinated for the 2010/2011 season.

"Findings from this study suggest that most schools are even less prepared for an infectious disease disaster, such as a pandemic, compared to a natural disaster or other type of event," says Terri Rebmann, PhD, RN, CIC, lead study author and associate professor of Environmental and Occupational Health at the Saint Louis University School of Public Health. "Despite the recent H1N1 pandemic that disproportionately affected school-age children, many schools do not have plans to adequately address a future biological event."

The researchers conclude that U.S. schools must continue to address gaps in infectious disease emergency planning, including developing better plans, coordinating these plans with local and regional disaster response agency plans, and testing the plan through disaster drills and exercises. Whenever possible, school nurses should be involved in these planning efforts, as healthcare professionals can best inform school administrators about unique aspects of pandemic planning that need to be included in school disaster plans.

Plex fans among us just got treated to a smorgasbord -- albeit one that isn't completely free. The media front-end developer hopes to boost its bottom line through PlexPass, a subscription service that amounts to a paid beta program. Shell out $4 per month and you'll get early access to in-development features, including a slate of premium-only extras during their incubation phase. One of the more ordinary (if important) features is going live today: a revamped Web Client not only rivals the native OS X app for speed but offers full media playback on top of the usual queue management. Whether you subscribe or not, you'll want to get an updated Media Server app that supports both PlexPass and the new client along with improving the server's behavior in several areas, such as lowering its memory use and supporting RTMP transcoding. We hope Plex keeps enough components on the free side of the fence as time goes on. For now, at least, we'll see the paid model as a way for loyalists to reward a company that has been powering their home theater PCs for years.

Notre Dame football: Pinkett bumped from broadcast

DUBLIN ? Allen Pinkett?s words have bumped the former Notre Dame football standout off Saturday?s Irish season-opening radio broadcast.

On Wednesday, the Notre Dame football radio analyst made controversial comments that quickly drew reaction from ND athletic director Jack Swarbrick, former Irish quarterback Joe Theismann and Pinkett's employers at the IMG Notre Dame Sports Network, among others.

Pinkett, a former All-America running back, later apologized for saying during an interview on a Chicago radio station: "I've always felt like to have a successful team you've got to have a few bad citizens on the team."

IMG Sports, in the same statement suggested disciplinary action was coming, and Thursday it became official.

?Allen Pinkett, a commentator on the IMG Notre Dame Radio Network who made unacceptable comments this week about student athletes, will not be part of this weekend?s broadcast in Dublin,? read a statement distributed by IMG. ?Don Criqui and Jeff Jeffers will handle the broadcast duties.

?Notre Dame taking on Navy at the Emerald Isle Classic in Dublin is an historic game showcasing the very best of American college sports. The event deserves to be free of distraction. Further decisions on this matter will be made in the coming days.?

Kickoff for ND?s opener with Navy is 9 a.m. EDT. The broadcast can be heard locally on WSBT (960 AM, 96.1 FM).

Four Notre Dame players ? running back Cierre Wood, defensive end Justin Utupo, linebacker Carlo Calabrese and quarterback Tommy Rees ? are suspended for Saturday?s season opener against Navy at Aviva Stadium in Dublin, Ireland. Wood and Utupo are also suspended for the following week?s game, against Purdue.

On Thursday, after his team went through its first practice in Dublin, Irish coach Brian Kelly was asked about Pinkett?s comments.

?I can?t comment on what he said. There?s no thought process in that for me,? Kelly said.

?I can just tell you what I want, and I want tough gentlemen. I want tough guys on the field that are gritty, play the game the right way, that you can count on, on fourth-and-1 that they?re going to knock you in the nose. And off the field I want gentlemen.?

Pinkett made the trip to Ireland with on the team charter Wednesday afternoon, but Kelly said the two men didn?t have any conversations during the flight.

In the (time) zone

Kelly said that there were no all-nighters pulled on the charter flight to Dublin, although there were variances in the amount of sleep his players got.

?They all got some sleep. I don?t think it got to the point where we had to go back there and shake anybody, but we certainly had some guys that didn?t get enough sleep and they?ll get it tonight,? said Kelly, who planned a 9 p.m. bed check for Thursday night.

One player who did seem to get a fair amount of shut-eye was fifth-year senior Kapron Lewis-Moore.

?I actually fell asleep before the meal,? the defensive end said, ?but from what people say it was pretty good.?

Zoned out

Navy linebacker Keegan Wetzel was well aware of the five-hour time difference between the East coast and Dublin, but it hit home as the Mids were traveling across the Atlantic Ocean.

?We?d only been on the plane for a couple hours,? Wetzel said, ?and all of a sudden the sun was up.?

  • Among those watching Notre Dame?s practice from the sidelines Thursday were a number of ND players out with injuries.

    They included safety Austin Collinsworth (shoulder), tight end Alex Welch (knee), running back Amir Carlisle (ankle) and offensive tackle Tate Nichols (shoulder).

    Also watching were two players who were recently removed from the active roster and placed on medical scholarship, running back Cameron Roberson and offensive lineman Brad Carrico.

  • Linebacker Danny Spond, who was sidelined recently because of migraine headaches, was in full uniform on Thursday. Kelly expects him to work his way into practice contact as soon as next week.
  • Navy?s flight to Dublin was delayed a couple of hours, pushing its practice back to mid-afternoon Thursday.
  • Both teams practiced on a FieldTurf surface on Thursday. The practice field is adjacent to Aviva Stadium.

    Samsung announces Galaxy Note 2!

    We're live at Samsung Mobile Unpacked 2012 in Berlin, where Samsung has just announced the latest device in its Galaxy Note line, the Galaxy Note 2! The Note 2 is the widely-anticipated successor to last year's original Galaxy Note, and Samsung's improved upon that device with souped-up internals, re-vamped software and a brand new design.

    The Galaxy Note 2 sports a 9.4mm thin chassis with a 5.5-inch 16:9 display at 1280x720 resolution. The screen itself is an HD SuperAMOLED panel, similar to what Samsung's included on the Galaxy S3. Visually the Galaxy Note is similar to the Galaxy S 3. The home button, the rear of the phone, the overall shape all strike a resemblance to the smaller sibling. Like its predecessor, the Note 2 sports a Wacom-based pressure-sensitive "S Pen," which has been redesigned. The pen is now taller and thicker, the button on the side now has texture to it, and it has a rubber tip which creates a subtly different action on the screen.  

    On the inside, the Galaxy Note 2 is powered by a 1.6GHz Exynos 4 Quad CPU -- the same CPU found inside the S3, only at a higher frequency. That's backed up by 2GB of RAM and 16,32, and 64GB of storage. Samsung will offer the device in both 3G/HSPA and 4G LTE flavors, though for the moment there's no info on which version will be offered in which markets. On the software side, there's Android 4.1.1 Jelly Bean, backed up by Samsung's TouchWiz Nature UX. And like the original Note, pen-centric apps like S Note have been included to take advantage of the new Note's unique hardware.

    Kindergarten readiness: Are shy kids at an academic disadvantage?

    ScienceDaily (Aug. 28, 2012) ? Parents of young children hope for a successful kindergarten experience that will set their youngsters on the right path of their educational journey. Some worry about their kids not adapting to the school environment, particularly when the children are talkative and overactive. Yet, a new study by the University of Miami (UM) shows that overly shy preschool children are at greater academic risk than their chatty and boisterous peers.

    The study is one of the first to follow the social and academic progress of children throughout the preschool year. The report shows that children displaying shy and withdrawn behavior early in the preschool year started out with the lowest academic skills and showed the slowest gains in academic learning skills across the year. The findings are published online, in advance of print, by the Journal of School Psychology.

    "Everybody wants their children to be ready for kindergarten, to know their ABCs and to be able to count, but they sometimes don't understand that having social-emotional readiness is equally important," says Rebecca J. Bulotsky-Shearer, assistant professor of psychology at UM College of Arts and Sciences (CAS) and principal investigator of the study.

    Behavioral problems in the classroom arise when there is a gap between the child's developmental skills and the expectations of the school environment, according to the study. The findings suggest that children who are shy in the classroom have trouble engaging and learning.

    "Preschool children who are very introverted tend to 'disappear within the classroom,'" says Elizabeth R. Bell, doctoral candidate in developmental psychology, at UM and co-author of the study. "It appears that while these children are not causing problems in the school, they are also not engaging in classroom activities and interactions, where almost all learning occurs during this age."

    The results also raise the possibility that children who are loud and disruptive may be more likely to get the teacher's attention and benefit from specific educational strategies. "There are many classroom-based interventions for children that are disruptive and acting out in the classroom," says Bulotsky-Shearer. "I think the children who show an extreme amount of shyness and are withdrawn are most at risk of getting missed."

    The researcher hopes the new findings encourage the development of appropriate classroom interventions tailored to the needs of different children, as well as appropriate training and professional development for teachers, to help them identify children who need help in specific areas. "This is especially important within early childhood programs such as Head Start, serving a diverse population of low-income children and families," says Bulotsky-Shearer.

    The study analyzes information from 4, 417 prekindergarten children in the Head Start Program, ages 3 to 5, from a diverse population, living in a large urban district of the northeast. Six profile types were used to describe the preschoolers: 1.Well adjusted; 2. Adjusted with mild disengagement; 3.Moderately socially and academically disengaged; 4. Disruptive with peers; 5.Extremely socially and academically disruptive; 6.Extremely socially and academically disengaged.

    The teachers assessed the emotional and behavioral characteristics, as well as the academic progress of each child, at three points in time during the preschool year. The findings show that older kids and girls tended to be better adjusted to the class, exhibited less behavioral problems, and had higher levels of social literacy, language and math skills.

    The study is titled "Latent Profiles of Preschool Behavior within Learning, Peer, and Teacher Contexts: Identifying Subgroups of Children at Academic Risks across the Preschool Year." Ximena Dominguez, research social scientist, at SRI International is also a co-author of the study.

    This post has been a long time coming. It is a personal experience that I felt I needed to share with others, as I truly felt alone dealing with pica during all my pregnancies.

    Pica is describe as : "the intense craving for ? and eating of ? non-food items, such as soil, clay, laundry starch, ice, ashes, plaster, paint chips, and coffee grounds. Pica (which comes from the Latin word for magpie, a bird known for eating almost anything) is a worldwide phenomenon and seems to be more common during pregnancy as described?BabyCentre.com?.

    I had an unusually strong craving for the smell of ?Lestoil. Pinesol would do in a pinch, but Lestoil was my smell of choice. I was told that my Grandma used Lestoil in her house but I was very young when she died, so don't I really remember that part of her. I was very far from my close knit family and childhood home during?all my pregnancies and maybe this was my minds way of finding comfort in my new home. The smell engulfed me, it made me feel safe, warm almost euphoric.

    I didn't notice a problem until my husband came home and complained that the house smelled like a urinal. I was completely offended, how could he say that this clean & welcoming home smelled like a men's washroom!

    The worst of this situation came about as my husband headed to the airport to get my parents at the end of my first pregnancy. I decided that there was no way my parents could stay in a room with dirty windows. In my pregnancy wisdom, I decided to climb onto the roof of our front porch to clean the windows. Yes, picture it. Nine months pregnant, Lestoil, Windex and paper towel in hand, cleaning the outside of the windows. As I was cleaning my parents arrived. Let's just say, they talked me in off the ledge.

    As my parents eyes began to water due to the strong smell of Lestoil, I final realized the full extent of my issue. My wonderful OBGYN, was more than understanding. She explained that as long as I didn't want to drink the Lestoil I was fine. I did fail to tell her I had been tempted to drink it but didn't and that twice during my pregnancy I drove panicked to the 24 hr grocery store in the middle of the night to buy more cleaner.

    Interestingly, enough the moment I returned home from the hospital with baby in tow, the effect had worn off. The smell became offensive, empty almost hollow.?Each of the subsequent two pregnancy had the same symptoms, the house was clean but smelled overwhelmingly like an hockey change room bathroom stall.

    Very few people knew about my little Lestoil addition, but after speaking to a pregnant friend this week, who is having a little pica moment of her own, I wanted to share my experience. Pica is normal is usually signifies an iron deficiency. The message in the post is simple, you are not losing your mind this too will pass and I wish someone had shared that with me that 10 years ago.

    Undaunted by storm reports, Republicans descended on Florida as Mitt Romney's team worked Sunday to cram four days of events into three after the threat of tropical storm Isaac forced the soon-to-be nominee to scale back his national convention.

    Blue skies with patches of clouds hung over Tampa early Sunday, though winds were picking up as the major storm approached.

    As aides in Tampa scramble, Mr. Romney is taking a rare day off the campaign trail at his lakeside vacation home in New Hampshire, receiving updates on the storm and making final preparations for the Thursday speech with which he will accept the Republican Party's presidential nomination.

    "The safety of those in Isaac's path is of the utmost importance," Romney tweeted after Republican officials announced they had called off Monday's convention proceedings.

    Because of possible storm surges and flooding Isaac could bring, convention organizers said they were making contingency plans to move delegates who have been booked into beachfront hotels to other locations if necessary. They indicated the schedule shift also was meant to prevent overburdening emergency response personnel at the height of the storm.

    The GOP made the announcement late Saturday, saying that while the convention would officially be gaveled into session on Monday as scheduled, events would be postponed until Tuesday.

    Convention spokesman James Davis said organizers were closely monitoring the storm's path but planned to rely on emergency management officials to guide decisions on whether to relocate delegates at waterfront hotels. So far, none has been moved nor had officials received word of major problems for inbound delegates.

    Mr. Davis said the GOP's advice to delegates was "if your travel plans have not been interrupted and they're set, we recommend you come on down."

    With Isaac boring down on the coast, President Obama, who had been at the?Camp David presidential retreat in Maryland, dispatched the Federal Emergency Management Agency to establish a command center and move more resources into the state. Vice President Joe Biden scrapped a planned campaign trip into Florida that was to counter the start of the GOP convention.

    Republicans hope to use this week's convention to cast Romney as a determined leader with the know-how to fix the country's economy. They also want to introduce him as a family-oriented figure to counter the image of him as a ruthless businessman, as Democrats have sought to brand him.

    Romney and his wife, Ann, looked to show off the more personal side with a joint interview airing Sunday.

    Travers history: Alpha, Golden Ticket in dead heat

    SARATOGA SPRINGS, N.Y. (AP) ? A bit of Travers history unfolded at the finish line at Saratoga Race Course when Alpha caught Golden Ticket at the wire and the two finished in a dead heat for the win Saturday.

    It was the first official dead heat for the win in the 143 runnings of the Travers. The 1874 Travers ended in a dead heat, but Attila was declared the official winner after a runoff with Acrobat.

    The finish had the crowd wondering who won for several minutes as the photo finish sign flashed on the infield toteboard. A few minutes later, the numbers of Golden Ticket and Alpha appeared, with the words dead heat alongside.

    Fast Falcon finished third, a neck behind the winners. Atigun was fourth, followed by Nonios, Neck 'n Neck, Stealcase, Speightscity, Liaison, Five Sixteen and Street Life.

    A Travers missing most of the top 3-year-olds, including retired Kentucky Derby and Preakness winner I'll Have Another and Belmont winner Union Rags, turned into a race to remember on the 50th anniversary of another great finish. In the 1962 Travers, Jaipur and Ridan dueled the entire race before Jaipur won by a nose.

    Alpha came into the Travers off a win in the Jim Dandy, while Golden Ticket was a last-minute entry by McPeek and had won only one of nine career starts.

    Israel ex-soldiers say troops abused Palestinian kids

    Former Israeli soldiers who served in the occupied territories say that mistreatment of Palestinian children by troops is "routine" and occurs even at times of relative calm.

    A collection of over 30 testimonies published on Sunday by Breaking the Silence, a group of ex-servicemen critical of army practices, says physical violence, often arbitrary, is used against very young children.

    "The testifiers depict a routine in which Palestinian minors, often under 10 years of age, are treated in a manner that ignores their young age," says the 72-page booklet.

    Entitled "Children and Youth: Soldiers' Testimonies 2005-2011," it covers a period after the second Palestinian intifada, or uprising, of 2000-2005.

    "Although the events described here took place after the peak of the second intifada, at a time perceived as calm and uneventful from a ?security? standpoint, the reality that emerges from the testimonies shows that harsh treatment of Palestinian children continues unabated," it says.

    In one example, a former staff-sergeant, unidentified like most who give testimony, describes a punitive raid on a neighbourhood in the Ramallah area following earlier clashes with Palestinians.

    He said a dozen soldiers with wooden clubs "beat people to a pulp. Finally the children who remained on the ground were arrested. The order was to run, make people fall to the ground," he said.

    "A slow runner was beaten, that was the rule," he said.

    Another former staff-sergeant describes an operation against the West Bank village of Azzun, where stones had been thrown from a curve in the road at motorists from the nearby Israeli settlement of Maale Shomron.

    "We got to the village, drove up to the houses closest to the curve, and then saw a group of children, 9-10 years old, running away," he said.

    "First they ran, went onto the balcony of some house, and then the commander took a stun grenade and hurled it into that balcony. It blew up. I don?t think it hurt them or anything, but it made them run out of the balcony."

    He describes a chase after the children during which his commander cocked his firearm and aimed in the face of one of them from close range.

    "The kid was just freaking out, certain he was going to be killed, and begged and pleaded for his life," the soldier said.

    "A kid has to beg for his life? A loaded gun is pointed at him and he has to plead for mercy? This is something that scars him for life."

    The Israeli military said in response that Breaking the Silence had not provided it with sufficient background material to enable it to investigate specific claims.

    "By compiling testimonies over long periods of times and refusing to provide additional details, the organisation proves its true intentions -- rather than facilitating proper investigation, the organisation seeks to generate negative publicity regarding the IDF and its soldiers," it said in a statement.
